2. The accused/petitioner seeks bail in connection with Sursand P.S. Case No. 30 of 2025 registered for the offences under Sections 137(2), 96, 3(5) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').

3. The accused/petitioner is named in the First Information Report and is in custody since 24.01.2025.

4. Allegation against the petitioner is to kidnap the minor daughter of the informant aged about 16 years alongwith other co-accused persons for the purpose of illicit intercourse /marriage with another person.

It is submitted by learned counsel appearing on behalf of the petitioner that thrust of allegation is available against coaccused namely, Krishna Kumar, who alleged to kidnap the minor daughter of the informant, as he was in love with her. It is submitted that petitioner implicated in this case only for the reason that he is the brother-in-law of the main co-accused Krishna Kumar. It is pointed out that the victim regularly uploading her video on different social media platforms saying that she is living happily with co-accused Krishna Kumar.

6. While concluding argument, it is submitted that petitioner is a man of clean antecedent and, moreover, investigation of this case is already concluded, for which charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.

7. Learned A.P.P. for the State, while opposing the prayer for bail of the petitioner, fairly conceded that the thrust of allegation is available against co-accused Krishna Kumar.

In view of aforesaid factual submission and by taking note of the fact as implication of this petitioner is primarily appears due to his relation with main co-accused Krishna Kumar, who specifically alleged to kidnap the minor daughter of the informant, coupled with the fact that petitioner, who is a

No.24805 of 2026(4) dt.15-07-2026 3/3 man of clean antecedent, remains in custody since 24.01.2025 and trial of this case is not likely to be conclude in near future, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Sitamarhi/concerned court, in connection with Sursand P.S. Case No. 30 of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
