JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2018 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in Phulwaria (Fulwaria) P.S. Case No. 101 of 2017 instituted for the offence under Sections 147, 148, 149, 307, 341, 324, 326, 506 of the Indian Penal Code and Section 27 of the Arms Act.
As per allegation in the written report, on 6.9.2017 in the
Patna High Court Cr.Misc. No.3887 of 2018 (3) dt.20-03-2018 2/2 General Store of Munna Singh, two groups were engaged in altercation after drinking wine due to sale and purchase of wine. In first group members were Chand, Lalua, Baua Jee, Munna Singh and the second group members were Subodh Kumar, Vikash Kumar, Ranjit Kumar, Raja Kumar along with some unknown persons. Both group exchanged firing and also threatened each other. During exchange of firing, three villagers sustained injury and were taken to private clinic at Begusarai for treatment. It is further alleged that both group members gave threat to the informant that if case will be lodged, he will be killed by them. Case diary has been received.
The learned A.P.P. has submitted that there is specific allegation against the petitioners that they exchanged firing after drinking wine in which three villagers sustained injury. In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.
Prayer for anticipatory bail of the petitioners stands rejected.
Petitioners may surrender before the court below and make prayer for regular bail.
