This application is filed for grant of regular bail in connection with Laheriasarai P.S. Case No. 34 of 2018 registered under section 364/34/302/201/120(B) of the Indian Penal Code.

The prosecution story is short is that the informant Rohit Kumar received information on phone that his brother Rahul Kumar Das has been kidnapped. Informant rushed from his Nanihal and reached on the spot where he came to know that Chandan Das, Md. Asraf, Nandan Das and Dhiraj Kumar were assaulting to Rahul Kumar Das in front of the house of Sahdeo

Patna High Court CR. MISC. No.25838 of 2023(2) dt.24-05-2023 2/2 Master in the Gali of Donar Middle School. and alleging to kill him and took away on motor cycle on the point of pistol crossing the Railway barrier towards Dilawarpur Mohalla. It is also alleged that Chandan Kumar Das threatened to kill his brother and in the year 2013, Chandan Das has killed his father. Informant believes above named four person kidnapped his brother Rahul Das with intention to kill him. Learned counsel for the petitioner submits that the petitioner is in custody since 27.10.2021.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class Darbhanga in connection with Laheriasarai P.S. Case No. 34 of 2018.
