JUSTICE SUDHIR SINGH ORAL ORDER 10-01-2017 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 323, 332, 333, 337, 338, 353, 307 and 153A of the Indian Penal Code.
The prosecution case, in short, is that on 7.10.2016 the informant, on getting information that scuffle between two groups is going on, went at the P.O. and found that the accused persons including the petitioners and 50-60 unknown persons armed with weapons, bricks etc were abusing each other by their caste name. The police tried to pacify the matter, but they threw bricks on the police party in which the police party sustained injuries. It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.337 of 2017 (2) dt.10-01-2017 2/2 there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made. No specific injury has been attributed against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) eachwith two sureties of the like amount each to the satisfaction of A.C.J.M.- II, Saran, Chapra in connection with Marhowra P.S. case No.467 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
