JUSTICE ARUN KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf o the State.

Petitioner apprehends his arrest in connection with Complaint Case No.856-C/16, giving rise to Trial No.3521/17, registered under Sections 376, 511 and 452 of the Indian Penal Code.

Allegation in brief is that the petitioner entering into the house of the complainant made an attempt of rape. Learned counsel for the petitioners submits that the husband of the complainant and petitioner are agnates and there is some land dispute between them. Earlier two police cases were also instituted by the complainant side and the allegation is absurd

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., III, Bettiah, West Champaran in connection with Complaint Case No.856-C/16, giving rise to Trial No.3521/17, subject to the conditions as laid down under Section 438(2) Cr.P.C.
