ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.01.2019 in connection with Mashrak P.S. Case No.41 of 2019 registered for the offence under Sections 413 and 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner that he was on the red colour Mahindra Tractor which was stolen vehicle, which is wholly false and mischievous as the petitioner was in fact riding vehicle which is not stolen vehicle. It is submitted that the petitioner has got no criminal antecedent and has been falsely implicated by the informant on mere suspicion.

Considering the aforementioned facts and

No.25215 of 2019(2) dt.19-04-2019 2/2 circumstances and that admittedly as is evident from the FIR, two other persons namely, Mantosh Mahto and Sukhan Mahto were on stolen vehicle and the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Chapra, in connection with Mashrak P.S. Case No.41 of 2019.
