JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner, counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Nautan P.S. Case No.219 of 2017 registered under Sections 323, 324, 379, 308, 504, 506/34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner has no criminal antecedent and the incident took place on account of dispute over cutting grass from the field of Suresh Yadav. Counsel for the petitioner further submits that although there is allegation of assault by Garasi but the nature of injury was found to be simple in nature by hard and blunt substance. Considering the facts aforesaid and the nature of allegation

Patna High Court Cr.Misc. No.13767 of 2018 (2) dt.05-04-2018 2/2 made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ist, Bettiah in connection with Nautan P.S. Case No.219 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
