JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Trial No. 3718 of 2018, arising out of Complaint Case No. 1857 of 2017, lodged for the offences punishable under Sections 341, 323, 504, 506, 120B, 406, 498A/34 of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

The case is under Section 498A IPC and it appears that petitioner has earlier been granted provisional bail vide order dated 22.6.2018 on the condition that he will keep his wife with him and bail bond was furnished on 11.7.2018. However, later on his provisional bail has been cancelled on the complaint that he was not keeping his wife with dignity and care.

Considering the entire facts and circumstances, this anticipatory bail application is not maintainable, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit and learned court below shall also consider the fact as to whether there is chance of any settlement between the parties and after considering the same he will pass an appropriate order.

With the above observation, this application is dismissed.
