JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-12-2020 Heard learned counsel for the petitioner, learned counsel for the informant/opposite party no.2 and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.

The petitioner in association of his family members is said to have tortured mentally and physically the complainant/opposite party no.2 on non-fulfillment of demand of dowry.

Patna High Court CR. MISC. No.24230 of 2020(4) dt.17-12-2020 2/3 It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case as due to cruel behaviour of opposite party no.2, the petitioner has filed a divorce case before the Family Court. As a matter of fact, petitioner is the only son of his father who is an agriculturist having landed property. The opposite party no.2 intends to transfer all properties of the joint family of the petitioner in her name and to sell the same for setting at the Bangalore where the petitioner is working as well as to give her the money. It is further submitted that petitioner is paying Rs.15,000/- per month to opposite party no.2 till any adjudication is made by the Family Court with regard to maintenance case in compliance of the order dated 26.07.2019 passed in Cr. Misc. No.15666 of 2019.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarari in connection
