JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379 and 504 of the Indian Penal Code. The prosecution case is that in the background of land dispute, the FIR named accused persons including the petitioner came variously armed when on the order of Md. Hasim, coaccused Abdul Suhan abused the informant and attempted to cause injury with bhala but the informant received injury on the back and when the sister and cousin of the informant came to rescue, they were also assaulted. It is alleged against the petitioner that she assaulted with bamboo stick on the head of Sairun Nisha. Patna High Court Cr.Misc. No.53352 of 2015 (2) dt.24-11-2015 2/2 levelled. Injury of Sairun Nisha has been found to be simple in nature. It is further submitted that other similarly situated accused has been granted anticipatory by a co-ordinate Bench of this Court vide Cr. Misc. No. 18587 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation in the background of land dispute and the petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Purnea in connection with Amour P.S. Case No. 16 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
