JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 216(A) of the Indian Penal Code.

Petitioner has misused the privilege of bail for more than 18 years and due to his none co-operation, the case of the year 1998 is still pending.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Mairwa P.S.Case No. 130 of 1998, pending in the court of learned Additional Chief Judicial Magistrate, Siwan

Patna High Court CR. MISC. No.24620 of 2019(2) dt.18-04-2019 2/2 stands rejected However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/ production of a copy of this order. It is also made clear that if the trial of the petitioner is not concluded within the above stated period of six months, the petitioner may renew his prayer for bail before the trial court itself.
