The petitioner is apprehending arrest in a case registered for the offences punishable under Section 273 of the Indian Penal Code and 47a of the Excise Act.

The prosecution case is that from the grocery shop of the petitioner 50 bottles of country made liquor, each containing 400 ml, were recovered.

It is submitted by learned counsel for the petitioner that there is nothing on record to show that the grocery shop belongs to the petitioner. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.51045 of 2015 (2) dt.09-11-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Shankarpur P.S. Case No.108 of 2015, pending before the learned CJM, Madhepura.

With the above observation, this application is, accordingly, disposed off.
