The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 379, 447 and 504 of the Indian Penal Code.
The prosecution case is that petitioner no.1, Sarabjeet Ram entered into the house of the informant in inebriated condition and on protest being made he went back to his house and came with other accused persons variously armed and attacked the informant. Petitioner no.2 Amarjeet
Patna High Court Cr.Misc. No.51144 of 2015 (2) dt.09-11-2015 2/3 Ram assaulted to the brother of the informant causing fracture injury. Petitioner no.1 inflicted injury with axe on the neighbour of the informant namely Banshi Chaurasiya, he also caused injury to Mahendra Chaurasiya and Yogendra Pandey. It is further alleged that petitioner no.1 snatched `50,000/- from Shashikant Chaurasiya.
It is submitted by learned counsel for the petitioners that the petitioners are agnates of the informant. Four persons received injuries from the informant's side which apparently appears to be simple, though, with regard to some of them, opinion has been kept reserved, when five persons have received injuries from the petitioners' side. There is counter version of the occurrence also. In the background of property dispute, the occurrence took place. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st
