The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406, 420, 379, 120B of the Indian Penal Code.

As per FIR, one Vishwajeet Kumar who always committed theft in the shop of the informant, therefore, continuously sent money to the account of the petitioner by various mode. It is also alleged that petitioner and Vishwajeet Kumar along with one Prem Kumar Gond committed defalcation of Rs. 35 lakhs from the shop of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner rather allegation levelled against him is general and

Patna High Court CR. MISC. No.26490 of 2023(2) dt.13-07-2023 2/2 omnibus in nature. He submits that the petitioner is neither directly or indirectly related from the said alleged transaction. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Learned APP for the State opposes the prayer for bail.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Siwan Muffasil P.S. Case No. 411 of 2021.
