JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner prays for anticipatory bail in connection with Bhargama PS case no. 138 of 2016 registered for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code.

The allegation against the petitioner is that he has got Rs. 1,55,000/- for brick soling work but he has not completed the work.

It is submitted on behalf of petitioner that petitioner could not start the work as there was labour problem and after lodging of the case he has deposited the amount which is shown at Annexure 2.

Having heard both sides and in view of the fact that amount has already been deposited by the petitioner, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-, Araria in connection with Bhargama PS case no. 138 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that he will cooperate in the investigation of the case and will make himself available before police when required.
