JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Begusarai Mufassil (Singhaul) P.S. Case No. 623 of 2019 for the offence under Sections 399, 402, 414, 120(B) and 115 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Learned counsel for the petitioner would submits that the allegation against the petitioner and others, as per prosecution, is that for commission of crime, out of six persons three fled away. Three persons including the petitioner were caught at the spot and from possession of the petitioner, one loaded desi Katta; .315 bore (Desi Katta), one live cartridge of .

He further submits that co-accused Rohit Kumar and Chandan Kumar have been granted bail vide orders dated 24.02.2020 and 03.03.2020 passed in Cr. Misc. No. 9438 of 2020 and Cr. Misc. No. 15315 of 2020, respectively. Petitioner is in custody since 27.11.2019.

Considering the fact that the petitioner is in custody for more than 11 months and other accused persons have been granted bail by different Benches of this Court, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil (Singhaul) P.S. Case No. 623 of 2019.
