JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-07-2016 The petitioner has filed this application for quashing the first information report of Vigilance Case No.68 of 2013 (Special Case No.39 of 2013) instituted for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988 against him.
In view of the subsequent development which took place during the pendency of the present application, the learned counsel for the petitioner seeks leave to withdraw this application in order to file another application before this Court in case the Special Judge, Vigilance takes cognizance of the offences and summons the petitioner on perusal of the police report submitted in connection with Special Case No.39 of 2013 arising out of
Patna High Court Cr. WJC No.941 of 2015 (3) dt.21-07-2016 2/2 Vigilance Case No.68 of 2013, which according to the learned counsel for the petitioner has been registered in complete violation of the law laid down by this Court in the matter of Sakal Deo Paswan vs. The State of Bihar reported in 2015(3) PLJR 790. Leave is granted.
