====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-10-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sherghati P.S. Case No. 293 of 2016 for the offence under Sections 302 and 201 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 19.06.2019 passed in Cr. Misc. No. 28461 of 2019 with direction to the learned court below to conclude the trial within a period of six months from the date of order and also with an observation that if the trial is not concluded within the stipulated period, the petitioner may renew his prayer for

Patna High Court CR. MISC. No.27206 of 2020(2) dt.21-10-2020 2/2 bail. The trial of the case is still pending and there is no likelihood of its conclusion in near further and the petitioner is rotting in judicial custody since 09.07.2016 i.e. more than four years and on the ground of period of custody, the petitioner has renewed his prayer for bail.

Considering the facts and circumstances of the case and the period of custody, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IV, Gaya, in connection with Sherghati P.S.
