Patna High Court Cr.Misc. No.6667 of 2018(2) dt.12-02-2018 2/3 petitioners and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.
Twelve petitioners, apprehending their arrest in Complaint Case No.1115/2015 registered for the offence under Sections 420, 467, 468, 471, 504, 120(B) of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender. Sri Singh, learned Senior Counsel appearing on behalf of the petitioners, by way of referring to the complaint petition, submits that it was a purely case of civil dispute, however colour of criminal offence has been given. He further submits that petitioner nos.1 to 9 are purchaser of the land, whereas petitioner no.10 is a deed writer and petitioner nos.11 and 12 stood as witness in the sale deed. He further submits that regarding present dispute, one title suit vide T.S. No.348 of 2015 is already pending.
