The petitioners apprehend their arrest in connection with Goriakothi P.S. Case No. 09 of 2017 registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.
Allegedly, the petitioners kidnapped the sister, aged about 14 years, of the informant but during investigation the victim girl was recovered and she in her statement, recorded under Section 164 Cr.P.C., has stated her age 19 years and learned Magistrate assessed her age 18 years and she has stated that she was in love with Ranjan, she performed marriage with him out of her own sweet will, she was not kidnapped by anyone and she
Patna High Court Cr.Misc. No.35161 of 2017 (2) dt.10-08-2017 wants to live with Ranjan.
Submission is of false implication and that no offence as alleged is made out. The victim is major one and as such the petitioner deserves sympathetic consideration. Learned APP submits that the victim in her statement u/s 164 Cr.P.C. has not supported the allegation of kidnapping. In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Goriyakothi P.S. Case No. 09 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
