JUSTICE PURNENDU SINGH ORAL ORDER 20-06-2024 Learned counsel appearing on behalf of the petitioner seeks to file detailed representation before the Executive Engineer, Public Work Department, Patna Division, Patna (Respondent No. 5) in light of the decision of the Full Bench of this Court passed in L.P.A. No. 166 of 2018.

Learned counsel for the State has fairly submitted that in supplementary counter affidavit, averment has been made in paragraph no. 11 to distinguish the case of the petitioner without giving any notice to the petitioner or hearing the petitioner to place his case and, as such, the authority can decide

3. Considering the rival submission, the Executive Engineer- Respondent No. 5, is directed to pass appropriate order in light of the decision of the Full Bench of this Court passed in L.P.A. No. 166 of 2018 within a period of eight weeks from the date of communication of this order.

4. Accordingly, the present writ petition is disposed of.
