The present application, under Section 439(2) of the Code of Criminal Procedure, has been filed seeking cancellation of bail granted to opposite party No. 2, who is on bail in connection with Awatar Nagar P.S. Case No. 51 of 2015, registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.909 of 2017 (2) dt.16-01-2017 2/2 petitioner that the petitioner, who is the informant of the said case, has received an anonymous letter containing threats of dire consequences if he did not get the matter compromised. It has also been stated that opposite party No. 2 is threatening the petitioner otherwise also for getting the case compromised.
On the basis of the materials, which have been brought on the record, I do not think it to be a fit case for cancellation of bail granted to opposite party No. 2. However, if the petitioner approaches the Superintendent of Police, Saran, for any protection in this regard, the Superintendent of Police shall look into it and take necessary steps to ensure that the petitioner is not unnecessarily harmed.
This application has no merit and is, accordingly, rejected, but with the direction as above.
