2. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per prosecution case, on 09.12.2023 at about 2:30-3 AM, 15 to 20 unknown persons came and took away 80 meters of cable wire by tying the hands and legs of the security guard.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioners are not named in the

Patna High Court CR. MISC. No.27602 of 2026(2) dt.11-05-2026 2/2 F.I.R.. Name of petitioners transpired in this case during investigation, merely on the basis of confessional statement of co-accused persons. No stolen articles were recovered from possession of these petitioners.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that name of these petitioners transpired in this case during investigation and petitioners have got one criminal antecedent.

6. Considering the facts and circumstances of the case, nature of accusation and criminal antecedent of the petitioners, the prayer for grant of anticipatory bail to the petitioners is rejected.
