It is the case of the petitioner that she has already proceeded maintenance proceeding in which ex-parte order for grant of monthly maintenance was ordered and on account of the fact that she is unable to go to Bettiah to defend herself, she seeks transfer of the case from Bettiah to Darbhanga.
Patna High Court MJC No.754 of 2014 (4) dt.13-09-2017 2/2 Having heard learned counsel for the parties and keeping in view the reasons indicated in the application and finding that original proceedings for maintenance initiated by the present petitioner is pending in Darbhanga, this application is allowed.
Accordingly, Matrimonial Case No. 233 of 2012, pending in the Court of learned Principal Judge, Family Court, Bettiah is directed to be transferred to the Court of learned Principal Judge, Family Court, Darbhanga.
With the aforesaid, the application stands allowed and disposed of.
