====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-10-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Konch P.S. Case No. 336 of 2019 arising out of Posco Case No. 130 of 2019 for the offence under section 341, 354, 337,/34 of the Indian Penal Code and Section 8/12 of the Posco Act. Learned counsel for the petitioner submits that petitioner has been made accused in this case precisely for eyeteasing. Learned counsel further submits that the victim belongs to the same locality and in her statement under section 164 Cr.P.C. she did not name the petitioner.

Considering the statement under section 164, Court is inclined to grant anticipatory bail to the petitioner,subject to the condition that the petitioner shall deposit Rs. 25000/- cash in the

No.23372 of 2020(2) dt.09-10-2020 2/2 court below and on depositing Rs. 25000/- the court below shall release the petitionr named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of communication of a copy of this order, on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Posco Act), Gaya, in connection with Konch P.S. Case No. 336 of 2019 arising out of Posco Case No. 130 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.

The deposit of Rs. 25000/- shall abide by final outcome of pending criminal case.
