The petitioner apprehends his arrest in a case under Section 25 (1-B) a, 26 (i) (ii) and 35 of the Arms Act. The police raided a place and two persons were apprehended from whose possession arms and ammunitions were recovered. The petitioner managed to flee away. The name of petitioner was disclosed by Ramkrishna Singh, the person who was apprehended on the spot.

The learned counsel for the petitioner submits that the petitioner had gone there to ease out. Nothing has been recovered from the possession of the petitioner. Considering the fact that the person, who was apprehended on the spot, disclosed the name of the petitioner and

Patna High Court Cr.Misc. No.51030 of 2015 (2) dt.08-12-2015 2/2 from that place arms and ammunitions were recovered, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders, learned court below shall consider the prayer for regular bail of the petitioner without being prejudiced from the order of this court.
