The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code, section 27 of the Arms Act and sections 10, 13, 16 and 20 of the UAP Act. As per the prosecution case, on information having been received about naxalites having gathered, it is stated by the informant that a raid was conducted. The petitioner and 42 others were identified and named. It is stated that there was exchange of fire in which about 17 rounds was fired by the police personnel while 32-35 rounds fired by the naxalites on each other.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.26000 of 2022(3) dt.13-01-2023 2/2 that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. No person was injured in the alleged occurrence. The petitioner is in custody since 21.11.2021.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the petitioner having remained in custody for more than a year since 21.11.2021 and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Laraiyatand P.S. Case no. 74 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Munger.
