The Petitioner apprehends his arrest in Falka (Pothia) P.S. Case No.273 of 2015 instituted for the offence under Section(s) 147, 148, 149, 323, 332, 333, 290, 291, 427, 435, 436, 337, 338, 379, 307 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Katihar.
It is alleged that on the date of occurrence the petitioner and other accused, as named in the First Information Report, damaged the property of hospital. They caused injuries to police personnel. They also burnt the Ambulance and other property of the hospital. The police party had to do firing in air to
Patna High Court Cr.Misc. No.111 of 2017 (3) dt.10-02-2017 2/2 control the mob.
The learned APP has submitted that as many as eleven police personnel sustained injuries although the injuries were said to be simple.
From para 3 of the petition, it appears that the petitioner has criminal antecedents. He is accused in case(s) instituted under Sections 386/34 & 364/34 Indian Penal Code. In view of such, this Court does not find it a fit case for grant of anticipatory bail.
Prayer is rejected.
The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
