JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 379/34 of the Indian Penal Code.

The prosecution case is that the petitioner and one Vishal Kumar assaulted the informant when Vishal Kumar snatched `3,800/- from the informant and handed it over to the petitioner.

It is submitted by learned counsel for the petitioner that thrust of accusation is against Vishal Kumar. The petitioner is the co-villager of the informant and nothing has been recovered from the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

No.51164 of 2015 (2) dt.09-11-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Gopalpur P.S. Case NO. 99 of 2015 pending in the court of learned JM, 1st Class, Patna. Accordingly, the application is disposed of.
