JUSTICE SUDHIR SINGH ORAL ORDER 17-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is of killing sister of the informant.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. Petitioner no. 1 is Bhaisur of the deceased and petitioner no. 2 is Dewar of the deceased. Petitioners have falsely been implicated in the present case. From perusal of paras-11, 12 and 13 of the case diary it is evident that husband of the deceased was suffering from mental disorder and the allegation of assault is specific against the husband of the deceased.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each
Patna High Court Cr.Misc. No.51135 of 2015 (3) dt.17-02-2016 2/2 with two sureties of the like amount each to the satisfaction of Smt. Seema Aram, learned Judicial Magistrate, Ist Class, Patna, in connection with Phulwarisarif P.S. Case no. 492 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
