JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 17-04-2015 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition. However, learned counsel appearing on behalf of the respondent nos.1 to 4, by referring to the averments made in paragraph 10 and 11 of the counter affidavit filed on their behalf, submits that the valid grievances of the petitioner have already been redressed. It is pointed out that the interest claimed by the petitioner over the security deposit is not permissible in view of the terms and conditions incorporated in paragraph 18 of the Memorandum of Agreement (Annexure-1) singed by the parties.

In above view of the matter, no useful purpose shall be served by keeping the present matter pending any longer, as the lawful grievances have already been redressed by the respondents. For the aforesaid reasons, the writ petition stands dismissed, but there shall be no order as to costs.
