JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Phulwari Sharif P.S. Case No. 868 of 2019 for offences under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

In view of the allegations of assault levelled against the petitioner, the Court is not inclined to grant privilege of anticipatory bail to him. Prayer for bail is, accordingly, rejected. However, the court below is directed to hear and dispose of the regular bail application on its own merits on the same day without being prejudiced by the order of rejection of this application.
