JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2023 The present writ petition has been filed seeking the following relief:- "1. That the present writ petition has been preferred for issuance of writ/writs directing the respondent authorities after issuance of writ of mandamus directing the District Magistrate, Patna for issuance of appointment letters in terms of 1" priority list prepared after issuance of directions by this Hon'ble Court vide order dated 14.10.2009 in CWJC No. 13265 of 2009 (Ram Naresh Prasad &

Patna High Court CWJC No.25747 of 2013(2) dt.20-07-2023 2/3 Ors. -Vs- The State of Bihar & Ors.), wherein Hon'ble Mr. Justice Navin Sinha issued mandamus directing the District Magistrate, Patna to issue advertisement for one time appointment of IVth Grade employees and complete the appointment process by 8-10 months and in compliance of the said order, the advertisement was issued and a panel was prepared, but unfortunately the appointment letters of these petitioners have not been issued due to unwarranted manipulated interest of the Additional District Magistrate, Patna, L/C, IVth Grade Appointment Committee in collusion with Deputy Collector, Nazarat and Establishment, the order of this Hon'ble Court has not been complied till date in the letter and spirit of order dated 14.10.2009 passed in CWJC No.

13265/2009 as well as order passed on 24.02.2013 passed in CWJC No. 41/2003 in case of petitioner Awadhesh Prasad Singh, wherein the Hon'ble Mr. Justice Shashank Kumar Singh has clearly observed that this court further directs that any further appointment of Class-IVth post shall be made after the aforesaid panel was up-dated and revised. The Hon'ble Court has disposed of the said writ petition observing in the order sheet for the purpose of appointment of petitioner Awadhesh Prasad Singh."

After some arguments, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach

Patna High Court CWJC No.25747 of 2013(2) dt.20-07-2023 3/3 the respondent-authorities, in case of any subsisting grievances. Liberty so sought is granted.

The present writ petition stands disposed off as not pressed.
