The petitioner apprehends his arrest in Dariyapur P.S. Case No. 73/2017, registered for the offences punishable under Section 30(A) of the Excise Act.
The police raided the house of the petitioner and 30 pouches each containing 200 m.l. of illegal liquor was recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the house is joint family property and many persons are residing, but it appears from the F.I.R. itself that the police got information that it was the petitioner who was dealing in country made liquor and on such information raid was conducted.
Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.19588 of 2017 (3) dt.12-07-2017 2/2 enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
