This is a petition for grant of anticipatory bail for offence under Sections 302, 201 and 34 of the Indian Penal Code. The offence alleged is of murder of the daughter of the informant.
Submission of the learned counsel for the petitioner is that the case diary would reveal that there is no eye witness of the occurrence.
Learned Additional Public Prosecutor does not dispute that there is no eye witness before the police. Considering the fact that only material against the petitioner is suspicion, let the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Samastipur Muffasil P.S. Case No. 99 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, V, Samastipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
