Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 379, 504, 506 of the Indian Penal Code. Allegation is against four named accused persons including the petitioner of commission of murderous assault against Dilip Sah, as a result whereof, Dilip Sah died. In the past, prayer for bail to the petitioner was refused in Cr.Misc. No. 38574 of 2019 on 25.09.2019 with direction to the learned Trial Judge to expedite the trial. The report of the learned Trial Judge dated 10.12.2020 reveals that only two prosecution witnesses have been examined up-till-now and warrant of arrest has been issued against the informant of the case.

No.26980 of 2020(5) dt.24-02-2021 2/2 Learned counsel for the petitioner submits that coaccused-Sunil Sah, having identical allegation, has already been allowed bail by a Coordinate Bench of this Court, vide order at Annexure-2. Petitioner is in custody since 27.02.2019. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hajipur Sadar Police Station Case No.150 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
