JUSTICE RAKESH KUMAR ORAL ORDER 17-11-2016 Heard Sri Prajesh Kumar, learned counsel , who was assisted by Sri Shree Prakash, learned counsel for the petitioner and learned Additional Public Prosecutor .

The sole petitioner apprehending his arrest in Chautham P.S. Case No. 88 of 2016 corresponding to (Special Case No. 09 of 2016) registered for the offence under section 20 of the Narcotic Drugs And Psychotropic Substances Act, has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case due to some political reason. He submits that even the recovered Ganja which is lesser than the smaller quantity i.e. only 400 gram Ganja was shown recovered from the house of the petitioner. On

Patna High Court Cr.Misc. No.43209 of 2016 (3) dt.17-11-2016 2/2 this ground a prayer has been made to extend the privilege of anticipatory bail.

However after examining the F.I.R. and the fact that recovery was affected from the house of the petitioner and at the time of raid petitioner fled away, there is no reason to extend the privilege of anticipatory bail.

The petition stands dismissed.
