====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-10-2020 Heard Mr. Akhouri Vipin Bihari Shrivastava, learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Gwalpara P. S. Case No. 13 of 2020 dated 29.01.2020, instituted for offence under Section 392 of the Indian Penal Code.

The informant was waylaid and was divested of his belongings. The informant claimed that he could identify the accused persons.

The petitioner is not named in the F.I.R. and his name has transpired in the statement of villagers with

Patna High Court CR. MISC. No.27017 of 2020(2) dt.20-10-2020 2/2 whom he has some enmity.

Till date he has not been put on test identification parade and he is in custody since 04.03.2020.

Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Udakishunganj, District - Madhepura in connection with Gwalpara P. S. Case No. 13 of 2020.

The petition stands allowed.
