====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 08-05-2026 Heard Mr.Braj Bhushan Poddar, learned counsel for the petitioner and Mr.Ram Naresh Ray, learned A.P.P. for the State.

2. The petitioner seeks bail, who is in custody since 31.08.2025 in connection with Balia P.S. Case No. 367 of 2025, F.I.R. dated 30.08.2025 registered for the offence punishable under Sections 137(2), 87, 3(5), 61(2) B.N.S..

3. Allegation against the petitioner is that he alongwith others kidnapped the informant's sister.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

5. Learned APP for the State, on the other hand, on the basis of the material available on the record and the case diary, has vehemently opposed the prayer for bail of the petitioner and submits that the victim was recovered and the petitioner was also arrested from the same room of the Mahakalika Hotel and apart from that the victim has supported the case of the prosecution and for the same set of allegation, the bail application of co-accused person namely, Dheeraj Kumar @Dheeraj Kumar has been rejected by this Court vide order dated 16.03.2026 passed in Cr. Misc. No.16624 of 2026.

6. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Balia P.S. Case No. 367 of 2025, pending in the court of learned J.M. I Begusarai.

7. Prayer is refused.
