The petitioner is in custody in connection with Masaurhi P.S. Case No. 131 of 2019, Special Case No. 1981 of 2019 for the offence under Section 30 (a) of Bihar Prohibition and Excise Act, 2018 (Amended).

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 25 liters country made liquor was seized. Learned counsel for the Petitioner submits that nothing was recovered from the conscious possession of the petitioner. He submits that petitioner is in custody since 19.02.2019. Considering the fact that the petitioner has no criminal antecedent, the Court in inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.24157 of 2019(2) dt.15-04-2019 2/2 Let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Act, Patna, in connection with Special Case No. 1981 of 2019 arising out of Masaurhi P.S. Case No. 131 of 2019.
