The petitioners are apprehending their arrest in connection with Laukahi P.S.Case No.31 of 2017 (G.R.No.257 of 2017) , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 354 (B), 448, 379, 307, 436, 337 and 504 of the Indian Penal Code.
Allegation against the petitioners is of assaulting and setting the house on fire.
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and the allegation of setting the house on fire has not been found true during the investigation.
Patna High Court Cr.Misc. No.23275 of 2018 (2) dt.19-04-2018 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner on the ground that there is specific allegation against the petitioner nos.1 & 6 of setting the house on fire and against the petitioner no.3 of sprinkling of K.Oill on the house and the order shows that the burn articles were found on the spot.. Having heard both sides, so far petitioner nos. 1 Ram Prasad Yadav, 3 Shambhu Yadav and 6 Raj Narayan Yadav are concerned, I am not inclined to grant privilege of the anticipatory bail, however the petitioner no.2 Naresh @ Ram Naresh Yadav, 4.
Ganga Prasad Yadav @ Ganga Ram Yadav and 5 Rajendra Yadav are concerned they are directed to surrender before the court below within a period of four weeks from the date of receipt of the order and on their surrender they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur, district Madhubani in connection with Laukahi P.s.Case No.31 of 2017 (g.R.No.257 of 2017) subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is disposed of.
