JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

No doubt, in huge quantity, Indian made foreign liquor was recovered but according to the prosecution case itself, petitioners were not caught on the spot and their names were disclosed by the villagers, who assembled on the place of occurrence after arrival of the police.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners do not have any criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of
