The sole petitioner, who is in custody in Purushottampur P.S. Case No. 06 of 2016 , Tr. No. 17 of 2016 registered for the offence under Sections 20, 22, 23 of the Narcotic Drugs And Psychotropic Substances Act since 18th January 2016 has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that informant has not disclosed exactly about the seized recovered material however , it was the petitioner who has disclosed that seized article was allegedly charas. From
Patna High Court Cr.Misc. No.43938 of 2016 (3) dt.15-12-2016 2/2 possession of the petitioner total 8 kilogram of charas was recovered.
Learned Additional Public Prosecutor submits that prayer for bail of co -accused has already been rejected by this court .
Considering the commercial quantity of the recovered charas , there is no reason to extend the privilege of bail. Prayer for bail stands rejected. However, considering the fact that petitioner is in custody since January 2016 while dismissing it is desirable to direct the court below to take all steps for early disposal of the case.
