JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Naubatpur P.S. Case No. 253 of 2017 for the offences punishable under sections 323, 341, 342, 354, 307, 504 and 506/34 of the I.P.C.
Allegation against the petitioner in the FIR is that he and his sons were assaulting Rahul, the son of the informant, after bringing him in the house and when the informant and her daughter Niru Kumari went there and tried to rescue, they assaulted the informant also and her daughter. The petitioner tried to outrage modesty of the informant and he was trying to open her
Patna High Court Cr.Misc. No.17258 of 2018 (2) dt.10-04-2018 2/2 Sari. The husband of the informant intervened then he was also assaulted by them and the petitioner snatched gold chain and earring.
Submission is of false implication, the petitioner and the informant are gotias and co-villager, allegation under sections 354 and 379 of the I.P.C is super addition, no offence under section 307 of the I.P.C is made out, petitioner has got no criminal antecedent and as such he deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, considering the allegation attributed against the petitioner, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of A.C.J.M-II, Danapur, Patna.
