1. The present petition has been filed for restoring a petition bearing Miscellaneous Jurisdiction Case No.2511 of 2011, which has stood dismissed on account of non-prosecution by an order dated 27.03.2018.

2. The learned counsel for the petitioner submits that on account of certain personal difficulty, the learned counsel for the petitioner could not appear before the Hon'ble Court when the case was called out for hearing, hence a sympathetic view be taken and the aforesaid case be restored to its original file.

3. Per contra, though the learned counsel for the respondent-State is present but there is no serious objection to restoration of the aforesaid petition.

4. Having regard to the facts and circumstances of the

Patna High Court MJC No.1394 of 2019(6) dt.11-01-2024 2/2 case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for restoration of the aforesaid case, bearing Miscellaneous Jurisdiction Case No.2511 of 2011 to its original file.

5. The petition stands allowed.
