JUSTICE BIRENDRA KUMAR ORAL ORDER 12-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 498A/379/34 of the Indian Penal Code and Section 3/4 of the D.P.Act. This is a case under Section 498A of the Indian Penal Code. The impugned order reveals that the husband was already allowed bail on the basis of compromise between the parties. In the aforesaid circumstances, there was no reason to refuse anticipatory bail to the petitioners, who are relations of the husband. Hence, let the petitioners, above named, in the event of

Patna High Court Cr.Misc. No.26663 of 2017 (3) dt.12-07-2017 2/2 their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad/Successor Court in connection with Jehanabad (Mahila) Police Station Case No.70 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
