The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 379, 427, 448, 354, 504, 506 of the Indian Penal Code and 3(1) (v) (x) (xi) (xv) of SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the accused persons came variously armed to the house of the informant, assaulted the informant and when Punam Devi and Yogendra Ram came to rescue they were also assaulted. It is further alleged that the accused persons took away box contained articles, jewellery and cash and thereafter the accused persons
Patna High Court Cr.Misc. No.51340 of 2015 (2) dt.10-11-2015 2/2 brought JCB machine and cut way soil from the darwaja of the informant.
It is submitted by learned counsel for the petitioner that the injury report of the informant suggests no visible injury and the similarly situated accused persons have been granted anticipatory bail vide Cr. Misc. No. 46218 of 2015. Though, the petitioner is accused in six other cases but in most of them final form has been submitted.
Considering the accusation in the background of land dispute and pending title suit, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Salkhua P.S. Case No. 124 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Saharsa.
With the aforesaid observation, this application is disposed of.
