JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-09-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Rahui Police Station Case No. 389 of 2020 registered for the offences punishable under section 394 of the Indian Penal Code. As per the prosecution case, three unknown accused persons riding on a motorcycle suddenly surrounded the informant and assaulted him by Hockey stick and snatched his mobile phone and purse containing cash of Rs.15,000/-. Learned counsel for the petitioner submits that the FIR is against unknown and petitioner's name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. Petitioner is in custody since 7.12.2020.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.35064 of 2021(2) dt.10-09-2021 2/2 bail and submits that the motorcycle used by the accused persons during commission of offence and looted mobile phone, have been found to be in the possession of the petitioner which shows the involvement of the petitioner in the alleged crime. In view of the nature and gravity of the allegation, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) shashi/- U T
