====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 05-05-2025 Heard Mr. Y.C. Verma learned senior counsel for the petitioner and Mr. Surendra Kumar, learned APP for the State. Petitioner seeks regular bail in connection with Aandar P.S. Case No. 61 of 2022 dated 25.03.2022 registered for the offences punishable under sections 363, 366 and 34 of the Indian Penal Code.
The main submissions advanced by petitioner's counsel are that the so-called victim was admittedly a major girl at the time of alleged occurrence, the prosecution's story narrated in the FIR is completely absurd as the informant alleged that in the late night at about 01:30 AM, the victim herself started going out of her home in suspicious condition after which her family members followed her and saw the victim going on a motorcycle with the accused and the said story is unbelievable. It is further submitted that the victim herself returned back and her statement recorded under section 164 of CrPC contradicts the FIR's story as she does

No.26192 of 2025(2) dt.05-05-2025 2/2 not mention four persons as being involved and one co-accused Ruby Khatoon has been granted bail by a co-ordinate bench of this Court vide order dated 04.03.2025 passed in Cr. Misc. No. 87896 of 2024. It is lastly submitted that the petitioner has fair and clean antecedent, has been languishing in jail since 25.09.2024 and against him the investigation has been completed. Learned APP for the State has opposed the prayer of the petitioner.
Considering the facts and circumstances of this case as well as aforesaid submissions and mainly the petitioner's young age and his custody period and also the completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner namedabove be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Aandar P.S. Case No. 61 of 2022.
