JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Jadopur P.S. Case No. 47 of 2017 for an offence under sections 323, 307, 341, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that allegation of assault is against Amarjeet Sahni. There is no specific overt act alleged against this petitioner. He further submits that similarly circumstanced other co-accused namely, Bhola Sahni and Golu Sahni were granted anticipatory bail by this court in Cr. Misc. No. 42866 of 2017 vide order dated 19.9.2017.
Considering the fact that similarly circumstanced other co-accused have been granted bail, let the petitioner, named
Patna High Court Cr.Misc. No.40647 of 2017 (3) dt.17-10-2017 2/2 above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM,XIV, Gopalganj, in connection with Jadopur P.S. Case No. 47 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
